It is an offence for an employer to offer or knowingly recruit an individual who is on the PVG Children’s list and/or the PVG Adult's list (i.e. barred) to undertake a regulated role. It is an offence for a listed individual to accept or carry out a regulated role.  
The only way for an employer to confirm that the individual is not barred from undertaking a regulated role is by checking the PVG scheme membership disclosure record held by Disclosure Scotland.

 

 

Responsibilities of employers

Confirm that an individual is not listed (i.e. not barred) from undertaking a regulated role by reviewing their PVG scheme membership.  

As both PVG and Disclosure records contain personal information, you should only share these with the people entitled to see them, see Disclosure Scotland Code of Practice.

Inform Disclosure Scotland if a PVG scheme member ceases undertaking a regulated role with you or leaves your employment.

Responsibilities of PVG scheme members

PVG scheme members must notify Disclosure Scotland of any change to their name or gender within three months of the change [1].  This is reduced to one month for those who are under consideration for listing or who are listed.      

PVG scheme members should notify Disclosure Scotland of a change of employer, address, email address, contact number as soon as possible [1].
